- Barbara Hansdatter and her first husband Hans Hansen lived on his family farm Bl?holtsg?rd, 7 Slg. Olsker. His probate in 1706 informs us that they had 3 sons and 2 daughters, and also that while Hans Hansen was serving as the "Oldermand i Sommergilde" (Summer Feast Chairman) being held at "Pillegaard i Olsker Sogn" on "anden Pendse dag" (the 2nd day of Pentecoste = the 24th of May 1706) he had been struck on the head with a rock by a Hans Olsen of Olsker parish, damaging the hat (valued in the probate at 2 Mark) he was wearing.
The N?rre Herred Tingbog (Northern District Court Records) provides more detailed information on the events of May 24th. The court case begins on July 16, 1706 wherein the county notary's clerk Casper Olsen summoned Oluf Andersen, Rasmus Olsen and Hans Olsen to court concerning "overlast, slag og hug" (harm, blows and cuts) which they had inflicted on Hans Hansen of Olsker, which was to cost him his life!
Various witnesses to the events were called to testify. First was Ole Mogensen of Olsker who told that on the second day of Pentecost during the summer party at the "Gildehuset" (feast house), there was a brawl between Ole Andersen and the priest's servant Matthias Nielsen. "Oldermand" Hans Hansen sought to make peace between them. Ole Andersen beat Hans Hansen "brencken" (= brenchen, violently) and Rasmus Olsen, who was Ole Andersen's son, took a "Hjulfj?l" (wheel rim) and beat Hans Hansen about his torso. Hans Hansen took hold of Ole Andersen and led him out the door and beat him with a bull whip about his head.
The next witness was Ole Jensen, who also reported on a fight between Matthias Nielsen and Ole Andersen at the feast house. When he came into the feast house, he found Hans Hansen toppled over a bench. The only thing he saw was a hand with a wheel rim. Next relating that outside the house Hans Hansen had beat Ole Andersen about the head with a bull whip. Then inside the house where Ole Andersen's daughter came in and complained that her father had been whipped. The next thing he saw was that Hans Olsen jumped over the farm fence. Then he saw that Hans Hansen was bleeding from the head. Someone said it was Hans Olsen, who had beaten him.
Thomas Pedersen of Olsker said he had come into the house together with Captain Niels Nielsen and found Hans Hansen on a bench. Hans Hansen told him that he had been struck by Hans Olsen on the head with a stone and if he died from this, it was Hans Olsen's fault.
Captain Niels Nielsen confirmed the story and added that Hans Hansen had sent for Hans Olsen. Hans Hansen's wife exhibited his hat, which has a hole in crown and lining. The hole was caused by the stone which Hans Olsen had used. On June 5th, Hans Hansen had sent for Niels Nielsen, along with Mogens Olsen, to come to him as he was very weak. When they came, was Hans Hansen in the "krubhuset" (= kr?behus?) and "gav sig ynkeligt" (complained pitifully) of pain. He was paralyzed on the right side, could not use his right hand or stand on his right foot. He had a headache. When they were with him, he began to shake and they thought he would die. But after fifteen minutes, he came to himself. Then came the priest S?ren Schade, who had been sent for. The priest said to Hans Hansen that now while he had "sind og sands, maal og m?le" (mind and senses, reason and speech" to tell what had happened. Hans Hansen replied that it was Hans Olsen, who worked on Myreg?rd, who had beaten him and if he died, his slayer. The pastor asked those present to remember what had been said. Hans Hansen's sister came to treat his head wound. She brushed the wound that was "ungef?r" (around) 2-1/2 fingers wide. She used a feather to lubricate the wound with oil and wine.
The next witness was Mogens Olsen, who confirmed the above testimony of Niels Nielsen. Followed by J?rgen J?rgensen, who was present at the feast house, but could not say who beat whom. All the witnesses were summoned to attend the next court session.
The court reconvened on July 30th, the first witness was Rasmus Jensen of Olsker who had been fetched by Hans Hansen's son Mogens Hansen, who told him that Hans Olsen wanted to kill his father. Together they walked from the farm gate and then to Hans Hansen, who had been beaten on the head with a stone and Hans Olsen shouting that "dj?vlen skulle fare i hans hjerte" (the devil should get into his heart).
Then Matthias Nielsen, who served the parish priest S?ren Schade. He said that there had been a fight and that Hans Hansen as chairman sought to make peace and reconciliation between the warring parties. Ole Andersen would not obey orders and he heard that several had turned on Hans Hansen instead. Ole Andersen was led out of the feast house and punished by the chairman with a bull whip.
Neighbor Niels Hansen of Olsker said he came to Hans Hansen on June 5th and thought that Hans Hansen was "temmelig til pas" (appeared to be fine), but the next day he was poorly. He thought from the start that his infirmity stemmed from the blow he had received from Hans Olsen. He also watched the priest's visit later in the day. Hans Hansen told the priest that he had been assaulted by Ole ?ster's son Hans Olsen. Hans Hansen had said that he could not put all the blame on Hans Olsen, as he had fought with him with stones and he might just as well have hit him, as he himself had been hit. S?ren Schade attestation from July 30th was presented and entered as evidence.
The casw was reconvened on August 13th, Casper Olsen allowed Esper Espersen to interrogate Laurids Jacobsen Gardener of Rutsker. He testified that on the 3rd of Pentecost (May 25th) he came to Hans Hansen at "Blaahusgaarden". He lay in his bed. Then he stood up and took off his clothes, which were smeared with blood. He said he had been in a fight with Ole Andersen, but that it was not he who had beaten him. He could not say whether there had been a beating on the head, which had cost him his life. Esper Espersen would call more witnesses at the next court session.
On September 3rd Esper Espersen from Vestermarie came as proxy for Ole Andersen and his two sons, Hans and Rasmus Olsen. He had summoned Hans Hansen's wife Barbara, as well as all previous witnesses in Barbara's lawsuit, as well as additional witnesses to assess the case.
The first witness was "Sandemand" (Reeve) Mogens Madsen, who said there had been complaints from the authorities about the fence which surrounds the meadow called Habedam being dilapidated, so that outside cattle got in and did harm to the other of farms stock. Mogens Madsen would therefore inspect the fence along with two others. As usual he proclaimed this at a church event and that all around Habedam were to meet on the 3rd of Pentecost afternoon at Laurs Nielsen's in Habedam. When he came to Habedam he asked a man from Allinge, Hans J?rgensen Hjulmager if he had heard anything about Hans Hansen. He told of fight and that Hans Hansen was in a very condition, and they hardly figured that he would survive. When they sat at the table Hans Hansen came into the room and sat down at the table with them. He said to those who had worried that there some truth to it, and that he might bite the dust. Then they had gone out to view the fence. Hans Hansen had said that they should receive payment from him (beer and spirits) for the failure of the fence. Hans Hansen bade them to come to his home. They had sat down for half an hour before S?ren Giversen Skr?dder came into the room and debated with Hans Hansen. They could not come to terms, S?ren Giversen asked him to go outside. Hans Hansen defied his wife and went outside. The witness did not see what had happened.
The next witness was Jens Ancher from Hasle. He offered to go up to Bl?holtsg?rd to bleed Hans Hansen during his illness. Hans Hansen had pain in the right side from head to foot and could hardly keep his right hand up to his head. The priest S?ren Schade had advised Hans Hansen to allow himself to be bleed and drink some of his own blood in vinegar. Which happened. The witness asked why his head was rolled in white canvas. Hans Hansen said it was nothing and it would soon be well. His wife had nursed the wound with oil and "blege vit" (= blege hvidt, white lead). Hans Hansen had not asked him to inspect the wound. He therefore did not know whether it was by the striking of a stone or anything else which had caused his death.
Laurids Jensen from Myreg?rd and Peder Ibsen, both from Olsker parish, were asked by Hans Olsen to inspect Hans Hansen's wounds. Hans Hansen was in bed when they came in and introduced themselves as Hans Olsen's appointed men. They had asked Hans Hansen if it really was Hans Olsen who had hit him hard. He could not accuse Hans Olsen as the one who was to blame for his weakness, which could cost him his life. Hans Hansen replied by saying "NEJ" (NO), he had no other weaknesses, so it had been been that (the pain). Clerk Mads Clemmedsen asked the witnesses the question of when to rule out that it was Hans Olsen's blow which had caused Hans Hansen to be so badly injured that he died of it. The witnesses would not answer, but referred to their previous testimony.
Then Laurids Nielsen of Habedam, who said that the 2nd day of Pentecoste, while he was at church in Olsker, heard prayers for Hans Hansen. He went after the sermon to Hans Hansen to see how bad it was with him. When he came into the room, Hans Hansen was in his bed. When he gave him his hand, Hans Hansen gave him his left. Hans Hansen groaned loudly and asked if this due to the blow he had sustained during the fight. No, he had said, "Men Gud bedre mig, her er alt andet, som mig er kommet paa, og suckede oc gaf sig" to which his wife replied: "hand hafver faaet det af beengstelse ofr mig, da jeg skulle l?ges i Barselsseng". When the witness was on the way out of the room Hans Hansen said that he was scared, as he was completely dead in one leg and thigh.
S?ren Giversen of Olsker said that on the third day of Pentecost came to drink "gierdsvide pantet" [S?ren Gifversen was sentenced for also not having upkept the fence]. S?ren asked Hans Hansen how much he had pledged. 3 mark, Hans Hansen said, which the witness would not accept. The men around the table (who had helped to inspect the fence) replied that it was decided, that he had to take care of the fence. There was nothing "snepperie" so they asked him to leave the room and Hans Hansen went after, when he left the room.
Albert Hendrichsen from a small house at "Aalekistedammen" said he came the third day of Pentecost with his neighbors to go "Gierdes vide". He said he could not notice any harm to Hans Hansen's head and limbs as he could get on and off his horse. He had not said that someone had "begransket" his head or "nogen badsker" had linked to his wounds. He was on the second day of Pentecost in the church and heard the priest pray for Hans Hansen from the pulpit and "han bad menigheden om forladelse p? hans vegne om hand hafde giort nogen imod enten med ord eller gierninger" (he asked the congregation for forgiveness on his behalf if he had made any objections either with words or deeds).
Einer Engelbretsen from the fortress' grounds he had been with Reeve Mogens Madsen, Hans Hansen and his neighbors when they went to view the fence. He had not noticed it there was anything wrong with Hans Hansen. The Sunday after Hans Hansen and his son had past the witness's house "agenes", the witness knew nothing of a fight or fights.
On the 10th of September, Niels Nielsen of Brogaard in Olsker told on the third day of Pentecost, when the Reeve Mogens Madsen commanded some parishes men to go view the fence and inspect the surrounding farm's fences. They met at Mogens Jensen's watermill. Mogens Madsen and Hans Hansen came together and pledged for the breaches in the fence. The fine would be paied by Hans Hansen and they would get beer and spirits. Hans Hansen went with them and was in poor condition.
Michel Hansen of Vestermarie came to his stepfather Niels Abrahamsen at Habedamsg?rd. The third day of Pentecost, when the sermon was over, he recalled that there was meeting some men to go inspect the fence. There he saw Hans Hansen at "herbergshuset" on the "Blaahuls gaard". Hans Hansen was happy and able to go with the others. He showed no signs of weakness.
Peder Aredsen of Olsker parish had heard that Hans Hansen was ill. When he visited him and asked what was wrong, he said he was not weaker than he used to be and that it did not matter. Some days later Hans Hansen and his brother Rasmus Hansen of R? parish went to Peter Aredsen's. There Hans Hansen stated that he was going to the see a woman in Olsker and seek help with his weakness.
On December 3rd judgement was delivered in the case between Hans Hansen's widow and Ole Andersen and his two sons. The District Bailiff reviewed the interrogations and referenced throughout the proceedings (four pages), the October 15th county notary's clerk's report and referred to the law 6, book 6, chapters 1 and 2 article that the three should be punished - life for life - and if they were convicted, they were outlaws. The defender J?rgen J?rgensen had made his statement on November 5th where his contention was that it could not be proved that the fight was the reason for Hans Hansen's death.
The district judge and the eight jurymen ruled that the fight was mutual and that it had happened at a public feast, where a cluster of good people had gathered. They really ought to be investigating whether or not Hans Hansen had been wronged by being beaten to the floor. Hans Hansen had even told that he was suffering from a strange disease. Several of the witnesses had reported that the day after the fight that had Hans Hansen felt comfortable and attended the fence inspection. Finally, described the attack in the area on which Hans Hansen had at his sickbed as a "popelsi slag" (apoplectic stroke). Ergo Hans Olsen and the other two can be found guilty of Hans Hansen's death.
Inspite of the ruling Hans Olsen (born c.1680) was not put to death. He would later be charged with theft and flee the island, on July 6, 1708 he was convicted for the theft. His wife, Marie Hansdatter (born c.1673), was aquitted of complicity in the theft on July 13, 1708, and his father, Oluf Andersen (born c.1650), was aquitted of complicity in the theft on October 19, 1708.
